Terms and Conditions of Service — Tu-MiShop.com
1. Acceptance of Terms
By accessing or using the Tu-MiShop.com website, you fully accept these Terms and Conditions of Service ("Terms"). If you do not accept them, please do not use the site.
2. Definitions
Tu-MiShop, we, our: the owner of the tu-mishop.com website (registered with VAT number 09911660968, Via Piero Gobetti 2, Abbiategrasso – MI).
User, Customer: a natural or legal person browsing or making purchases on the site.
3. Object and Scope
These Terms govern the use of the site and the purchase of products offered. They are binding on all users, whether browsing, registering, or purchasing.
4. Order Creation and Contract Conclusion
Sending an order constitutes an offer to purchase. The contract is considered concluded upon acceptance of the order by Tu-MiShop, notified via email along with the order details.
5. Prices and Payments
All prices are expressed in euros (€), include VAT, and are current at the time of purchase. Any obvious pricing errors are not binding on Tu-MiShop, which reserves the right to cancel the order if discovered before shipment.
6. Shipping
Shipping is carried out to the address indicated by the Customer. Delivery times and related costs are specified during checkout. Risk of loss or damage passes to the user upon delivery to the carrier.
7. Right of Withdrawal (for consumers only)
In accordance with Legislative Decree 206/2005 – Consumer Code:
The consumer has the right to withdraw from the contract within 14 calendar days of receiving the product.
Notice of withdrawal must be sent by email to gigagaudia@gmail.com, indicating the order number and the products to be returned.
The return must be made within a further 14 days, at the consumer's expense, barring defects or non-conformities.
The refund of the price paid (excluding any additional non-mandatory costs) will be made within 14 days of receiving the returned item, using the same payment method as originally used.
8. Condition of the returned product
The product must be intact, unused, and in its original packaging. Tu-MiShop reserves the right to reduce the refund if the value of the product has diminished due to use beyond what is necessary to establish its nature, characteristics, and functioning.
9. Exceptions to Withdrawal
The right of withdrawal cannot be exercised for:
Personalized, made-to-measure, or products sealed for hygiene reasons if opened
Services already fully performed, if performance began with the consumer's express consent and waiver of withdrawal
10. Liability and Warranties
Tu-MiShop is not liable for indirect damages or user computer records. Liability is limited to the value of the order. Any defects or non-compliance will be handled in accordance with applicable regulations.
11. Changes to the Terms
Tu-MiShop reserves the right to update the Terms at any time. Changes will be posted on the website; continued use of the service constitutes acceptance of the new conditions.
12. Applicable Law and Jurisdiction
These Terms are governed by Italian law. Any disputes will be subject to the exclusive jurisdiction of the Court of Milan, unless otherwise specified.
